Please read these Terms of Service carefully before using ViSitemap. By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. Acceptance of Terms

By creating an account, accessing, or using ViSitemap ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. These Terms apply to all users of the Service, including both free and paid subscribers.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

2. Description of Service

ViSitemap provides AI-powered visual sitemap generation, website crawling, sitemap editing, and analysis tools. The Service allows you to:

  • Crawl websites to generate sitemaps
  • View and analyze sitemap structures visually
  • Edit and modify sitemaps
  • Export sitemaps in various formats
  • Integrate with Google Search Console for additional insights

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

3. User Accounts

To use certain features of the Service, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept all responsibility for activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You may not share your account credentials with others or allow others to access your account. You are fully responsible for all activities that occur under your account, whether or not authorized by you.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Crawl or analyze websites that you do not have permission to access
  • Violate any applicable laws, regulations, or third-party rights
  • Use the Service to engage in or promote illegal activities
  • Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
  • Use the Service to transmit viruses, malware, or other malicious code
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use automated scripts or bots to abuse the Service or circumvent usage limits
  • Scrape or collect data from the Service for competitive purposes or to build a similar service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Remove, obscure, or alter any proprietary notices on the Service

We reserve the right to investigate and take appropriate legal action against anyone who violates this provision, including removing content and terminating accounts.

5. Usage Limits and Rate Limiting

The Service is subject to usage limits based on your subscription plan. These limits may include:

  • Number of website crawls per month
  • Number of pages that can be crawled per website
  • Number of sitemaps you can store
  • Number of exports per month
  • API rate limits (if applicable)

We implement rate limiting to ensure fair usage and prevent abuse. If you exceed your plan's limits or attempt to circumvent rate limits, we may temporarily suspend your access or require you to upgrade your plan.

6. Payment Terms

6.1 Subscription Plans

Paid features of the Service are billed on a subscription basis. You will be billed in advance on a recurring basis (monthly or annually, depending on your plan). By subscribing to a paid plan, you authorize us to charge your payment method for the applicable fees.

6.2 Payment Processing

All payments are processed securely through Lemon Squeezy, our third-party payment processor. We do not store your complete payment information on our servers. By providing payment information, you agree to Lemon Squeezy's terms of service and privacy policy.

6.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged at the then-current rate for your plan. We will provide advance notice of any price changes.

6.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will retain access to paid features until the end of the billing period for which you have paid.

6.5 Refund Policy

We offer refunds within 14 days of your initial purchase if you are unsatisfied with the Service. Refunds for subscription renewals are evaluated on a case-by-case basis. To request a refund, please contact us at support@visitemap.com. We do not provide refunds for partial billing periods.

6.6 Payment Failures

If a payment fails, we will attempt to charge your payment method again. If payment continues to fail, your account may be suspended. You are responsible for updating your payment information to avoid service interruptions.

7. Intellectual Property

7.1 Our Rights

The Service and its original content, features, functionality, and visual design are owned by ViSitemap and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

7.2 Your Rights

You retain all rights to the sitemaps you create and the content you input into the Service. By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your content solely for the purpose of providing the Service to you.

7.3 Aggregated Data

We may use aggregated, anonymized data derived from your use of the Service for analytical purposes, service improvement, and research. This data will not identify you or your specific websites.

8. Service Availability

While we strive to provide reliable service, we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. The Service is provided "as is" and "as available" without warranties of any kind.

We may perform scheduled maintenance that temporarily interrupts access to the Service. We will attempt to provide advance notice of scheduled maintenance when possible. We are not responsible for any loss or damage resulting from service interruptions.

9. Third-Party Services and Links

The Service may contain links to third-party websites or services that are not owned or controlled by ViSitemap. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such content, goods, or services available on or through any such websites or services.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you:

  • Breach these Terms of Service
  • Violate applicable laws or regulations
  • Engage in fraudulent or abusive behavior
  • Fail to pay for a paid subscription

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may also terminate your account at any time by contacting us or using the account deletion feature in your account settings. Upon account deletion, we will delete your data in accordance with our Privacy Policy.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. VISITEMAP AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, OR (iv) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

12. Limitation of Liability

IN NO EVENT SHALL VISITEMAP, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. IN NO EVENT WILL OUR AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

13. Indemnification

You agree to defend, indemnify, and hold harmless ViSitemap and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of [Arbitration Body], except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ViSitemap regarding the Service and supersede all prior agreements and understandings, whether written or oral, regarding the subject matter.
